1Services Provided

Jared Next Day Home Improvement LLC provides outdoor design and construction services including, but not limited to:

• Landscape design and 3D visualization
• Hardscape and softscape construction
• Decks, pergolas, patios, and outdoor living spaces
• Project management and construction oversight
• Lighting, planting, and material planning

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

2Use of Services

You agree to use our Services in compliance with all applicable laws and regulations, including A2P messaging compliance, CAN-SPAM Act, TCPA, and other data protection laws. You must not use our services for any unlawful or unauthorized purpose.

3SMS & Messaging Terms

If you opt in to receive SMS messages from us:

• You must opt in to receive messages, and all opt-in data and consent must be verifiable.
• Marketing messages will include opt-out language such as "Reply STOP to unsubscribe."
• Message frequency will match the disclosures provided at the point of opt-in.
• Message and data rates may apply.

We do not guarantee message delivery, and carriers are not liable for delayed or undelivered messages.

4Client Responsibilities

As our client, you agree to:

• Provide accurate and lawful information about your property and project
• Be responsible for securing any necessary consents, HOA, or legal approvals not covered by our permitting services
• Use our services ethically and in line with industry standards

5Payment Terms

All payments for services are due as agreed in your design proposal, construction contract, or invoice. Late payments may incur additional fees. We reserve the right to suspend service for nonpayment.

6Intellectual Property

All materials we create for you — including designs, 3D renders, plans, and drawings — remain the intellectual property of Jared Next Day Home Improvement LLC until payment is received in full. Upon full payment, ownership of the approved design deliverables may be used by you as agreed in writing.

7Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement, unless disclosure is required by law or consented to in writing.

8Limitation of Liability

We provide our services "as is" and disclaim all warranties beyond those expressly stated in your project agreement. Jared Next Day Home Improvement LLC is not liable for any indirect, incidental, or consequential damages arising from the use of our Services, except as required by law.

9Termination

We may terminate or suspend services if you breach these Terms. Upon termination, all outstanding balances for work performed remain due, and you must cease all use of our proprietary materials.

10Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions.

11Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website and become effective upon posting.
